These supplemental terms and conditions for the One Click Multi Buy (“OCMB” or “Bundles”) feature on Binance.US (“OCMB Terms”) govern your use of OCMB and supplement the Terms available at https://www.binance.us/terms-of-use. Except as otherwise noted, all provisions of the Terms also apply to your engagement with OCMB features, and all terms and clauses contained in the Terms are incorporated by reference.
From time to time, BAM may make available a OCMB or Bundle feature, that allows users to simultaneously purchase multiple Digital Assets. When available, the OCMB feature will allow you to select a bundle of digital assets to purchase simultaneously through a simplified interface. Prices may include a spread. If you do not agree to the price, fees, or selection of digital assets made available, you should not use the OCMB feature.
Purchases made through an OCMB feature are Transactions as described in the Terms. As with other Transactions, BAM may contract with market makers, including market makers under common ownership to BAM, and market makers that are incorporated or otherwise operating outside of the United States, to promote liquidity and facilitate trading on the Platform and with respect to your OCMB transactions.
BAM may also make available a recurring buy feature to schedule multiple OCMB Transactions. If you do, BAM will attempt to process your transaction according to the schedule set, until cancelled by you or BAM. Prices will fluctuate and the price charged for each Digital Asset transaction will be the price reflected in the OCMB feature at the time of purchase, including any applicable fees or spread.
The particular Digital Assets available for purchase through OCMB may vary from time to time, and BAM makes no warranty or representation regarding the continued availability of any Bundle or particular Digital Asset.
Each Digital Asset purchase as part of an OCMB Transaction is an individual Transaction. It is possible that when using an OCMB feature, the purchase of one Digital Asset in the Bundle will succeed while one or more other attempted purchases fail. In this case, you will receive and pay for only the successfully purchased Digital Assets. You will not be charged for and have no entitlement to Digital Assets not successfully purchased. As provided in the Terms, and without limitation, BAM does not represent or warrant that any Transaction will be completed successfully or within a specific time period. Under no circumstances shall any of the Indemnified Persons be responsible or liable for any direct or indirect losses (including loss of profits, business, or opportunities), damages, or costs suffered by you or any other person or entity due to the failure of a Transaction or the length of time needed to complete any Transaction.
