SPONSOR
The Sponsor of the 5 Year Anniversary Giveaway (“Giveaway”) is BAM Trading Services Inc. d/b/a Binance.US (“Binance.US”). By participating in the Giveaway, each Entrant (defined below) unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Sponsor, which shall be final and binding in all respects. Sponsor is responsible for the collection, submission, or processing of entries and the overall administration of the Giveaway. For any questions, comments or problems related to the Giveaway. Sponsor may be reached by submitting a ticket to Customer Service at https://support.binance.us/hc/en-us/requests/new during the Promotion Period.
ELIGIBILITY
The Giveaway and each prize is open only to Binance.US account holders who are legal residents of every jurisdiction in which the Binance.US platform is available to individual users in the United States, without limiting the foregoing, excluding residents of Alaska, American Samoa, Connecticut, Georgia, Guam, Maine, Northern Mariana Islands, New York, North Carolina, North Dakota, Ohio, Oregon, Texas, U.S. Virgin Islands, Vermont, and Washington, who are the greater of (i) eighteen (18) years of age or (ii) the minimum age required to enter the Giveaway in their jurisdiction (each, an “Entrant”). Sponsor and its parent, affiliates, subsidiaries and advertising and promotion agencies and all of its officers, directors, employees, representatives and agents (the “Promotion Entities”), are ineligible to enter the Giveaway or win a prize. Household Members and Immediate Family Members of such individuals are also not eligible to enter or win. “Household Members” shall mean those people who share the same residence at least three months a year. “Immediate Family Members” shall mean parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses.
PROMOTION PERIOD
The Giveaway begins on September 24, 2024 at 3:00 p.m PDT and ends on September 27, 2024 at 2:59 p.m PDT (the “Promotion Period”).
The Giveaway will be one 3-day entry period.
HOW TO ENTER
To be eligible, Entrants must have a Binance.US account and User ID. Entrants must follow Binance.US on X/Twitter and reply to the post with the reason they use Binance.US.
Limit one (1) entry per person, per email address and/or Binance.US account per each Entry Period. Entries received in excess of this stated limitation will be void.
Additional rules and eligibility criteria may be communicated through other channels. Sponsor reserves the right to change the terms of the Giveaway at any time due to changing market conditions, risk of fraud, or any other factors Sponsor deems relevant. Sponsor reserves the right to disqualify any Entrants or transactions that show signs of fraudulent behavior or otherwise at Sponsor’s discretion. This Giveaway is subject to all applicable federal, state and local laws and regulations and is void where prohibited or restricted by law.
PRIZES AND APPROXIMATE RETAIL VALUE
During the Entry Period, every eligible entrant will be collected and (5) winners will be picked. The aggregate approximate retail value (ARV) of the prizes are:

Binance.US Hoodie - $50;
Binance.US T-Shirt - $20;
Binance.US Tote Bag - $15;
The ARV of the Prize represents the Sponsor’s good faith determination. This determination is final and binding and cannot be appealed. If the actual value of the Prize turns out to be less than the stated ARV, the difference will not be awarded in cash.
Winners must have a valid Binance.US account to redeem the Prize. Exact items awarded will be at the sole discretion of Sponsors. Sponsor prizes are not redeemable for cash and are not assignable or transferable. Any difference between the approximate retail value and actual value will not be awarded. If any portion of a Prize is not available for any reason, Sponsors reserve the right to substitute that portion of the Prize with another Prize element of comparable or greater value, as determined by Sponsors in their sole discretion. Winners will be responsible for all applicable federal, state and local taxes associated with claiming a Prize.
FURTHER RESTRICTIONS
Any attempt by Entrant to obtain entries fraudulently or to exceed entry limits by using multiple/different email addresses, identities, registrations, logins or any other methods will void Entrant's entries, and that Entrant may be disqualified. Final eligibility for the award of any prize is subject to eligibility verification as set forth below. All entries must be completed by the end of the Promotion Period in order to participate. Sponsor’s computer clock will be the official timekeeper for the Giveaway.
Binance.US reserves the right to disqualify participants for (1) violation of these Official Rules; (2) violations of applicable law;
DETERMINATION OF PRIZE WINNERS
Competition participants will be asked to create and submit content through a reply to the @Binance.US handle on each eligible social media platform, which is X. Each submission will be judged by Binance.US, in its sole discretion, based on creativity, quality, and humor (equally weighted) to determine the winning submission.
WINNER NOTIFICATION
Each potential winner will be notified via email or direct message on the social media platform through which they entered the Giveaway (X/Twitter entrants must have their account set to public), on or about the date specified. Potential winners must reply within 24 hours to claim the prize. Sponsor is not responsible for any delay or failure to receive notification for any reason, including winners’ failure to adequately monitor any account. Any winner notification not responded to or returned as undeliverable may result in prize forfeiture. To the extent permissible under applicable law, the potential prize winner may be required to sign and return an affidavit of eligibility and release of liability, and a publicity release (collectively, the “Prize Claim Documents”) as a condition of receiving the prize. No substitution or transfer of a prize is permitted except by Sponsor.
PRIVACY
Any personal information supplied by Entrants will be subject to the privacy policy of Binance.US posted at https://www.binance.us/en/privacy-policy. By entering the Giveaway, Entrant grants Sponsor permission to share their personally identifiable information with the other Giveaway entities for the purpose of administration and prize fulfillment, including use in a publicly available winners list.
LIMITATION OF LIABILITY
Sponsor assumes no responsibility or liability for (a) any incorrect or inaccurate entry information, or for any faulty or failed electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Giveaway; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, camera, computers or providers utilized in any aspect of the operation of the Giveaway; (d) inaccessibility or unavailability of any network or wireless service, the Internet or website or any combination thereof; (e) suspended or discontinued Internet, wireless or landline phone service; or (f) any injury or damage to participant’s or to any other person’s computer or mobile device which may be related to or resulting from any attempt to participate in the Giveaway or download of any materials in the Giveaway.
If, for any reason, the Giveaway is not capable of running as planned for reasons which may include, infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Giveaway, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Giveaway in whole or in part. In such event, Sponsor shall immediately suspend all drawings and prize awards, and Sponsor reserves the right to award any remaining prizes in a manner deemed fair and equitable by Sponsor. Sponsor and the Giveaway Entities shall not have any further liability to any participant in connection with the Giveaway.
ENTRANT AGREES THAT SPONSOR’S MAXIMUM AND AGGREGATE LIABILITY FOR DAMAGES ARISING OUT OF OR IN CONNECTION WITH THESE OFFICIAL RULES FROM ANY CAUSE OF ACTION WHATSOEVER, REGARDLESS OF THE FORM OF ACTION, WILL NOT EXCEED TEN DOLLARS ($10). IN NO EVENT SHALL SPONSOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES OF ANY NATURE WHATSOEVER, INCLUDING LOST PROFITS OR REVENUE.
